Terms of Service — MotorCast AI

These Terms of Service ("Terms") govern your access to and use of motorcastai.com and the MotorCast AI platform (the "Service") operated by MotorCast AI ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. The Service

MotorCast AI is an AI-powered platform that converts vehicle information (VIN, photos, listing details) into professional video advertisements with AI-generated voiceover. Output quality depends on the accuracy of inputs you provide and the capabilities of underlying AI services.

AI-generated content may contain errors, inaccuracies, or omissions. You are solely responsible for reviewing all generated content before publishing or distributing it.

2. Accounts

You must be at least 18 years old to create an account.
You are responsible for maintaining the confidentiality of your login credentials.
You are responsible for all activity that occurs under your account.
You must provide accurate and complete information when registering.
We reserve the right to suspend or terminate accounts that violate these Terms.

3. Payments and Refunds

MotorCast AI offers one-time purchases and monthly subscription plans. All prices are in USD.

Subscriptions are billed monthly and renew automatically. You may cancel at any time; cancellation takes effect at the end of the current billing period and no further charges will be made.
One-time purchases are non-refundable once the video generation job has been initiated.
Refunds for subscriptions may be issued at our discretion if the Service has not been used during the current billing period. Contact support within 48 hours of a charge to request a review.
Payments are processed by Stripe. By providing payment information, you agree to Stripe's terms of service.

4. Acceptable Use

You agree not to use the Service to:

Generate content that is false, misleading, or fraudulent regarding a vehicle's condition, history, or specifications.
Violate any applicable law or regulation, including consumer protection and advertising standards.
Infringe the intellectual property rights of any third party.
Attempt to reverse-engineer, scrape, or abuse the platform or its underlying APIs.
Upload content you do not own or have the right to use (including photos of vehicles you do not have permission to advertise).

We reserve the right to remove content and terminate accounts that violate this policy without prior notice.

5. Intellectual Property

You retain ownership of the vehicle photos and listing information you upload. By uploading content, you grant MotorCast AI a limited, non-exclusive licence to process that content solely for the purpose of generating your requested video.

The generated video output is owned by you upon successful delivery. MotorCast AI retains no rights to use your generated videos for any purpose other than operating the Service.

The MotorCast AI name, logo, platform design, and underlying technology remain the exclusive property of MotorCast AI.

6. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that generated content will be accurate or suitable for any particular purpose. AI-generated voiceovers and videos are produced by third-party AI services and we make no guarantees about their output.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOTORCAST AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Termination

You may close your account at any time by contacting support. We may suspend or terminate your access immediately if you breach these Terms, without liability to you. Upon termination, your data will be handled in accordance with our Privacy Policy.

9. Changes to These Terms

We may update these Terms from time to time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the federal and state courts located in Tennessee.
