MotorCast AI ("we", "us", or "our") operates the website motorcastai.com and the MotorCast AI platform (the "Service"). This Privacy Policy explains what information we collect, how we use it, and your rights regarding that information. By using the Service you agree to the practices described here.

1. Information We Collect

Information you provide directly

• Account details — name and email address when you create an account.
• Vehicle data — VIN numbers, license plate numbers, vehicle photos, and listing descriptions you submit to generate videos.
• Payment information — billing details processed securely by Stripe. We do not store raw card numbers.
• Support communications — messages you send to our support team.

Information collected automatically

• Usage data — pages visited, features used, timestamps, and error logs.
• Device and browser data — IP address, browser type, operating system, and referring URL.
• Cookies and similar technologies — session cookies required for authentication, and optional analytics cookies (see Section 6).

2. How We Use Your Information

• To provide and operate the Service, including generating AI voiceovers and videos from your vehicle data.
• To process payments and manage your subscription or one-time purchases.
• To send transactional emails (receipts, video-ready notifications, password resets).
• To monitor service health, fix bugs, and improve features.
• To comply with legal obligations and enforce our Terms of Service.

We do not sell your personal data to third parties.

3. Third-Party Services

The Service relies on the following sub-processors. Each operates under its own privacy policy:

• Stripe — payment processing (stripe.com/privacy).
• ElevenLabs — AI voiceover generation. Vehicle listing text is transmitted to ElevenLabs solely to produce the audio track (elevenlabs.io/privacy).
• Kling AI — AI video generation. Synthesised content is transmitted to produce the output video (klingai.com/privacy).
• PlateToVIN — license plate to VIN lookup. Only the plate number and US state are transmitted (platetovin.com/privacy-policy).
• Cloudflare R2 — file storage for uploaded photos and generated videos (cloudflare.com/privacypolicy).
• Railway — application hosting infrastructure (railway.app/legal/privacy).

4. Data Retention

Account data is retained for as long as your account is active. Generated videos and uploaded photos are stored for 90 days after creation, after which they are automatically deleted. You may request earlier deletion at any time by contacting us. Payment records are retained as required by law.

5. Data Security

We use industry-standard measures including HTTPS encryption in transit and access-controlled cloud storage at rest. No method of transmission over the internet is 100% secure; we cannot guarantee absolute security but take reasonable steps to protect your data.

6. Cookies

We use a strictly necessary session cookie to keep you logged in. We may also use analytics cookies to understand how the Service is used. You can disable cookies in your browser settings; doing so may affect login functionality.

7. Your Rights

Depending on your location, you may have the right to access, correct, or delete the personal data we hold about you, and to object to or restrict certain processing. To exercise any of these rights, email us at support@motorcastai.com. We will respond within 30 days.

8. Children's Privacy

The Service is not directed to individuals under the age of 16. We do not knowingly collect personal data from children. If you believe we have inadvertently collected such data, please contact us and we will delete it promptly.

9. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify registered users by email and update the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised policy.

10. Governing Law

This Privacy Policy is governed by the laws of the State of Tennessee, United States, without regard to its conflict of law principles. Any disputes relating to this policy shall be subject to the exclusive jurisdiction of the courts located in Tennessee.
